TERMS AND CONDITIONS

Bestourspt® operates as a licensed Portuguese travel and tourism agency in accordance with applicable Portuguese and European Union legislation.
2. Scope of These Terms
These Terms and Conditions govern:
- access to the website bestourspt.pt
- requests for quotations and travel planning
- booking of private transfers and private tours
- tailor-made travel experiences in Portugal
Specific details included in a quotation, proposal, voucher or booking confirmation form an integral part of the agreement. Where there is any difference between these Terms and a specific booking confirmation, the booking confirmation prevails.
3. Acceptance of Terms
By accessing this website, submitting a request or booking a service with Bestourspt®, you acknowledge that you have read and accepted these Terms and Conditions.
If you do not agree with these Terms, you should not use the website or request services.
4. Services Offered
Bestourspt® provides or organises tourism-related services including:
- Private transportation with driver
- Private sightseeing tours in Lisbon and Portugal
- Tailor-made travel experiences
- Walking tours and cultural experiences
- Cycling and gastronomy experiences
- Multi-day itineraries in Portugal
Some services may be delivered directly by Bestourspt® or through selected professional partners. All services are subject to availability and confirmation.
5. Quotations and Booking Confirmation
Quotations issued by Bestourspt® are indicative and non-binding until confirmed in writing.
A booking becomes confirmed only after:
- written confirmation by Bestourspt®; and
- receipt of the agreed payment or deposit
Payment may be requested through secure payment links (e.g. Stripe), bank transfer or other secure methods communicated in the quotation.
Bestourspt® reserves the right to decline or cancel a request prior to confirmation if operational, safety or availability constraints arise.
6. Prices and Payments
Prices are those expressly stated in the quotation, proposal, payment link or booking confirmation.
Unless stated otherwise, prices include VAT at the applicable Portuguese legal rate and cover only the services specifically listed.
Items not explicitly included may be charged separately, including:
- entrance tickets and professional guides
- meals or accommodation
- special equipment or child seats
- additional waiting time
- extra stops or route changes not originally quoted
Payments must be made within the timeframe stated in the quotation. Failure to complete payment within the specified period may result in cancellation of the reservation.
7. Operational Conditions
7.1 Pickup and Waiting Time
Clients must be ready at the agreed pickup location and time.
For airport services, complimentary waiting time starts from the later of the scheduled pickup time or the actual landing time of the flight.
Standard complimentary waiting times are:
- Airport pickup: 60 minutes
- Port or train station pickup: 30 minutes
- Other pickup locations: 20 minutes
Additional waiting time may be charged at EUR12 per 15 minutes unless otherwise specified in the booking confirmation.
If the client does not appear or cannot be contacted within the applicable waiting period, the service may be treated as a no-show and no refund shall be due.
7.2 Travel Information
Clients are responsible for providing accurate travel details, including flight numbers, pickup address, contact phone number, number of passengers and luggage details. Bestourspt® cannot be held responsible for service issues caused by incorrect or incomplete information provided by the client.
7.3 Luggage and Vehicle Capacity
Clients must ensure that luggage quantity and size are compatible with the booked vehicle category. If luggage exceeds the safe capacity of the vehicle, Bestourspt® may propose an alternative or additional vehicle at an additional cost.
7.4 Child Seats and Special Requests
Child seats or other special equipment must be requested in advance and are subject to availability and confirmation.
8. Changes Requested by the Client
Changes requested by the client, including date, time, itinerary, number of passengers or pickup location, are subject to availability and may result in a price adjustment. Bestourspt® cannot guarantee that requested changes can be accommodated once a service has been confirmed.
9. Cancellation Policy
Unless otherwise stated in the quotation or booking confirmation, the following policy applies to standard transfers and tours:
- Cancellation up to 48 hours before the scheduled service: full refund, minus any non-recoverable bank or payment processing fees.
- Cancellation between 48 and 24 hours before the scheduled service: 50% refund, minus any non-recoverable bank or payment processing fees.
- Cancellation less than 24 hours before the scheduled service: no refund.
For events, weddings, large groups, multi-day itineraries or services involving third-party reservations, the specific cancellation policy stated in the quotation or confirmation shall prevail.
9.1 Cancellation or Modification by Bestourspt®
If Bestourspt® cancels or is unable to deliver a confirmed service due to force majeure, severe weather, road closures, public authority restrictions, strikes, safety concerns or other events beyond our reasonable control, Bestourspt® will, depending on the circumstances and the extent of unrecoverable third-party costs already incurred:
- offer rescheduling to an alternative date; or
- issue a credit note or voucher valid for future services; or
- provide a partial or full refund after deduction of unrecoverable costs
The client will be informed of the applicable option as soon as reasonably possible.
10. Right of Withdrawal
Under EU consumer legislation, the 14-day withdrawal right does not apply to leisure services booked for a specific date or period of performance, to the extent permitted by applicable European Union and Portuguese consumer law.
11. Third-Party Services
Certain services may involve third-party providers such as guides, accommodation providers or experience partners. Bestourspt® cannot be held responsible for the acts or omissions of independent third-party providers except where liability is imposed by mandatory law.
12. Liability
Bestourspt® shall not be responsible for delays or service interruptions caused by events beyond reasonable control, including traffic, weather, road closures, flight delays, strikes, public authority restrictions or force majeure events.
Nothing in these Terms excludes or limits liability where such exclusion is prohibited by mandatory law, including liability for death or personal injury, fraud, or damage caused by gross negligence or wilful misconduct.
Where permitted by law, the total liability of Bestourspt® shall be limited to the amount actually paid by the client for the specific service giving rise to the claim. Bestourspt® is not responsible for loss, theft or damage to personal belongings unless directly caused by our gross negligence or wilful misconduct.
13. Insurance and Legal Compliance
Bestourspt® operates under RNAVT licence no. 12774 and maintains the insurance coverage required by Portuguese law for licensed travel and tourism agencies.
Where applicable under Portuguese law, traveller claims may benefit from the protections of the Fundo de Garantia de Viagens e Turismo (FGVT).
14. Intellectual Property
All content on this website, including text, design, branding, images and source code, is protected by applicable intellectual property law. Content may not be reproduced, distributed or reused without prior written authorisation from Bestourspt®, except where expressly permitted by law.
15. Complaints
Clients may submit complaints directly to Bestourspt® using the contact details published on this website.
Consumers may also submit complaints through the Portuguese Electronic Complaints Book: www.livroreclamacoes.pt.
16. Governing Law
These Terms are governed by Portuguese law. Disputes shall be subject to the competent Portuguese courts, without prejudice to mandatory consumer protection rules and any alternative dispute resolution rights available under applicable law.

2. Purpose of Data Processing
Personal data may be collected and processed in order to:
- respond to enquiries and prepare travel quotations
- manage bookings and deliver contracted services
- communicate operational details and issue vouchers or invoices
- comply with legal, tax and accounting obligations
- improve website functionality and user experience
- preserve partner attribution and referral source information linked to a booking or enquiry, including QR-based partner referrals
3. Types of Data Collected
Depending on the interaction, data collected may include:
- name, email address and telephone number
- travel details: pickup, destination, flight information, travel dates
- number of passengers and luggage information
- communication records and service-related correspondence
- transaction and invoicing data
- technical data such as IP address, browser type and navigation data
- referral and attribution data, such as UTM parameters, partner identifiers or QR code origin
4. Legal Basis for Processing
Personal data is processed on the following legal bases, according to the specific purpose:
- Contract performance, to process bookings and deliver services
- Pre-contractual measures, to respond to enquiries and prepare quotations
- Legal obligation, to comply with tax, accounting and regulatory requirements
- Legitimate interests, for fraud prevention, website security, partner attribution, internal reporting and business continuity
- Consent, for non-essential analytics, marketing communications and non-essential cookie-based technologies where required by law
5. Data Sharing
Personal data may be shared, where necessary and proportionate, with:
- drivers, guides and operational partners involved in delivering the service
- payment processors (such as Stripe)
- hosting, analytics and IT service providers
- accountants, insurers and legal advisers
- public authorities where legally required
All processors are required to respect confidentiality and applicable data protection obligations. Some service providers may be based outside the European Economic Area, see Section 6.
6. International Transfers
Where personal data is transferred outside the European Economic Area (for example, to analytics or hosting providers based in third countries), Bestourspt® implements appropriate safeguards as required by applicable law, which may include Standard Contractual Clauses (SCCs), adequacy decisions or other lawful transfer mechanisms.
7. Data Retention
Personal data is retained only for as long as necessary for the purposes for which it was collected. Typical retention periods are:
- Quotation requests: up to 12 months
- Communication records: up to 3 years
- Booking and invoicing data: 10 years (legal and tax obligation)
- Analytics data: according to platform configuration and user consent settings
- Consent records: retained for as long as necessary to demonstrate compliance
When data is no longer needed, it is deleted, anonymised or securely archived.
8. Data Subject Rights
Under applicable data protection law, individuals have the right to:
- access their personal data
- correct inaccurate or incomplete data
- request erasure in certain circumstances
- restrict or object to processing
- withdraw consent at any time where processing is based on consent
- request data portability where legally applicable

Where it is not strictly necessary, it is only activated after consent.
